Bollywood actor Shiney Ahuja on Sunday has confessed to physical relationship with his 18-year-old maid, according to television reports.

He was detained for questioning at a suburban police station after his domestic help alleged that he had raped her.

"The domestic help, who has been working at Ahuja's residence in suburban Oshiwara, alleged that the actor had raped her today afternoon," Deputy Commissioner of Police Niket Kaushik told PTI.

"We have registered an FIR and called Ahuja to the police station for questioning in the matter to verify the facts," he said.

The house maid in her complaint has alleged that Ahuja raped her at his residence when they were alone, Kaushik said.

Ahuja is married and is known for his roles in films like Hazaaron Khwaishein Aisi, Gangster, Woh Lamhe, Zindaggi Rocks, Bhool Bhulaiya, Life In A... Metro and Khoya Khoya Chand.

'We have to wait for more evidence'

Actor Shiney Ahuja [ Images ] was sent to three days in police custody on Monday for allegedly raping his maid.
Public Prosecutor S S Kasthure discussed the case in a telephone conversation with Nithya Ramani.

What charges have you pressed against Shiney?

I have pressed charges under Section 376 of the IPC (Indian Penal Code) (rape), 506 (threatening to kill) and 342 (wrongful confinement).

Why is it necessary for Shiney to be in police custody for three days?

For interrogation. Last night's statement (by the actor) is not valid. We have to wait for more evidence.

What other evidence do you have?

The medical evidence. They have identified injuries on the victim's private parts and semen samples.

There is also a lady who brought the victim from Bihar for employment to Shiney's house. She had gone to the house after the incident and brought her out. We need to find out why she was there and how she knew about the rape.

What will happen after the three days in police custody?

He will be put in judicial custody. He can apply for bail from the sessions court.

Will you oppose his plea for bail?

Of course, on medical grounds and circumstantial evidence and her (the victim's) statement I will oppose (a bail application).

What circumstantial evidence do you have?

The woman (who brought the maid from Bihar) being present at the scene after the incident. Shiney's wife and daughter not being there during the day.

Do you think the woman has any role to play in the incident?

No. In fact, she told the victim not to go to work to Shiney's house as she (the victim) wasn't feeling well.

Was the victim harassed prior to the incident?

Yes. She was molested the previous day, June 13, and raped on June 14.

What do you think was the motive? Was Shiney on drugs or was he drunk?

There are no reports suggesting that he was drunk. He was in his senses. It was a deliberate attempt to rape.

One newspaper and one television channel claims that Shiney is reported to have said it was consensual sex. Will that be taken into consideration?

His statement is not valid. Only the girl's statement is valid. We will fight on that basis only.

Did you talk to the victim? What is her state of mind?

I don't have the authority to talk to her. I can fight the case only on the basis of her medical reports, statement and FIR (First Information Report).

Today I was called by the police at the eleventh hour, so I fought the case on the basis of the reports the police gave me. They should have called me earlier so that I could read my case papers. I didn't have the time or opportunity to read it.

Will the victim to be allowed to go home?

She is not in the frame of mind and cannot go home. If she is allowed to go home, the parents will have to apply to the sessions court. Then she can go home.

'I was gagged and raped'

Mumbai: Bollywood actor Shiney Ahuja was arrested at 3 am on Monday on charges of raping his domestic help. Later, he was produced in court, and remanded in three-day police custody. The complainant, in her account to the cops, said that the actor had "wrapped her tight from behind" on Saturday, a day before she was allegedly raped.

Excerpts from her first-person narrative:
On Saturday (June 13), I was in the house doing the daily chores. I needed to open a water valve. It was beyond my reach. So, I climbed up on a container. As I was opening the valve, he (Shiney) wrapped me tight from behind. I got scared, but did not have the guts to say anything. His wife was not at home. Later, I thought that he might have done it with no bad intention. Perhaps, he thought that I would fall down and supported me.

So, I went to work again as usual on Sunday (June 14). I was busy doing cleaning work in the kitchen when he called me by my name. Since the other maid had gone to the church, I thought that he needed something.

Figuring that he was in the bedroom, I went and stood near the door. Before I could ask him anything, he pulled me inside by my hand and locked the door from inside. I started shouting. He told me not to shout as there was no one in the house who could hear me. He said that I should listen to whatever he said and do whatever he told me to do.

He then pushed me down on the bed. I tried hard to push him away and shouted. He clamped his hand on my mouth and gagged me. He was too powerful for me. He then took off my salwaar kameez and raped me.

I was crying. He told me to shut up and threatened to kill me if I reported the
incident to anyone. I got scared and sat in the room for a while. Later, I called my uncle. He calmed me down and advised me to approach the police.

Shiney’s medical reports awaited; victim not a minor

Actor Shiney Ahuja’s medical reports in the rape case against him are expected soon. Also awaited were the results of forensic tests conducted on various articles collected from Shiney’s house.

Among the items put through forensic analysis are:
- Bedsheet from Shiney's house.
- Vaginal swabs taken from the victim.
- Clothes worn by the victim and accused during the assault.

A six-member forensic team had collected samples from Shiney's flat in Oshiwara. The house was sealed afterwards.

Victim not a minor
The Mumbai Police has traced the age certificate of the domestic help allegedly raped by Shiney from her native place Rogha. Her date of birth has been found to be 2 April 1989 and confirmed by the tehsildar.

The medical report of the victim released on Tuesday not only confirmed rape, but also said her hymen was ruptured during the assault. The report also indicted marks of resistance on the victim’s body.

‘Didn’t know she would go to police’
During his interrogation, Shiney allegedly told the police he thought the domestic help had a good time with him.

Police: You belong to a good family, you are educated. You are an actor and you are married. Then when did you do it?

Shiney: Sir, I don't know why I did it. It just happened.

Police: Were you not scared that the girl would complain?

Shiney: No. I didn't know that the girl would approach the police. I thought she too had a good time. I thought she will be happy that is why I was sure she will not go to police.

Police: So you were over confident?

Former aide stands by Shiney
Shiney's previous maid Rajni has stood by the actor. “He is not like that,” she reportedly told police.

The police have also recorded the statements of Shiney's cook Mohan, another maid Sangeeta and the victim's 45-year-old aunt. The victim had rushed to her aunt immediately after the actor allegedly assaulted her. Her aunt worked for another resident of Tarapore Towers, where Shiney lived.

While Shiney's flat was on the 7th floor, the neighbour house was on the 15th floor in another block. The neighbour accompanied Shiney's maid and her aunt to the police station around 5.45 pm on Sunday.
